论我国行政复议与行政诉讼的关系

行政复议与行政诉讼之间有着密切的联系,同时又存在本质的区别。在行政复议与行政诉讼的关系问题上,应明确几个范畴:在地位上,行政复议相对独立于行政诉讼;在程序衔接上,以复议选择、司法终局原则为基本原则,以复议前置、复议终局为例外。进一步处理好二者之间的关系是维护公民、法人或者其他组织合法权益、促进依法行政与社会和谐的一项重要任务。
