论紧急状态法律体系之构建

紧急状态入宪之后,紧急状态法的立法研究工作随即启动。在紧急状态法的立法研究过程中,首先必须明确紧急状态法在国家法律体系中的定位及其性质问题,这决定着紧急状态法的立法基调。本文探讨了紧急状态法与宪法和国际人权法之间的关系,考察了紧急状态法应当具有的内在价值及其自身的特点,主张紧急状态法应当在紧急状态法律体系中具有“准宪法”的地位,同时,紧急状态法的内容应当具有原则性的特点。

The Construction of the Emergency Law System

After emergency-related affairs are included in the constitution, legislative studies of the emergency law are on the way. When making the legislative studies, we should first know clearly the nature and the position of the emergency law in our legal system, as these two aspects will set the keynote in the making of the emergency law. This article discusses the relationships of the emergency law and our constitution with the international human rights law, explores the features and the inner value that the emergency law should possess and the article insists that the emergency law should have the status of quasi constitution in the emergency law system and that the content of the emergency law should be highly principled.
