| 摘 要： | 斡旋受贿的构成一直是有争议的问题。其中,行为人与其他国家工作人员之间理解为有职务上的影响关系符合立法精神。而不正当利益的界定可以按受贿人、第三人是否违背职务上要求作判断标准。斡旋受贿的立法规定需要重新定位。

| Abstract: | The constitution of mediatory acceptance of bribe has always been a problem at issue.The relationship between the doer and other state personnels should be put into functionary connections of influence according to the legislative intent.The illicit interest should be defined according to the criterion that whether the bribe receiver or the third party violates functionary requests.The legislation of the crime of mediatory acceptance of bribe needs reconsideration. |
