| 摘 要： | 理论和实务界对于危险驾驶罪中"道路"范围的界定存在较大争议,从而直接影响到相关案件的定性。根据司法解释的规定,危险驾驶罪中"道路"的含义适用道路交通法中的相关规定,亦即包括"公路"、"城市道路"、"虽在单位管辖范围但允许社会机动车通行的地方"以及"广场、公共停车场等用于公众通行的场所"等四种类型。对于后两种"道路"类型的界定,可以借鉴日本司法实务中较为成熟的操作经验。

| Abstract: | Definition of scope of “road” in crime of dangerous driving in both theory and practice is controversial,which directly affect the qualitative of relevant cases. According to the regulation of judicial interpretation, meaning of “road” in crime of dangerous driving shall be applicable to traffic laws in the relevant provisions, which includes the “highway”, “city road”, “in the scope of the jurisdiction of the unit but allow society motor vehicles” and “plaza, public parks and other places for the public” and other four types. For the two types of definition, we can learn from Japan＇ s experience in relatively mature operation in judicial practice. |
