| 摘 要： | 无权处分是民法上的疑难症结,我国法学界对此争议较大。本文通过阐述我国学界的主要分歧,指出了我国无权处分立法上的缺陷,对理论界的主要观点进行了分析,对无权处分制度应如何重新建构提出了自己的建议。

| Abstract: | In the field of law there is a lot of controversy as to disposition beyond rights. After stating the main differences on disposition beyond rights, this essay, first of all, points out the flaws in the legislation of contract law in our country and gives further analysis of chief opinions in the academic field. Moreover, some personal proposals on how to reestablish the regulations on disposition beyond rights are put forward in this essay. |
