财产犯罪客体和犯罪对象之理论冲突与协调

犯罪客体与犯罪对象存在密切关系,但我国学者在研究财产犯罪时,却忽视了上述的关系,以致于在论述财产犯罪客体时大多认为财产犯罪侵犯了财物的所有权或占有权,而论述犯罪对象时却将不能体现所有权或占有权的财产利益等涵盖其中,造成了犯罪客体与犯罪对象的冲突.因此,研究当前我国刑法中财产犯罪对象和客体的冲突现状,提出二者协调的意见对于研究财产犯罪至关重要.

The Theoretical Conflict and Coordination Between Crime Object and Crime Target

There is a close relationship between crime target and crime object.However our scholar neglect the above-mentioned relation while study the property crime,so that while discussing the property crime object mostly thinks the property crime infringed upon the ownership of the wealth and properties or possessors' right,but not while discussing the crime target,resulting in the conflict between them two.Thereby,it is meaning well to study and put forward how to coordinate the present conflict condition of the property crime object and target in the current criminal law.
