两岸权利质权之比较

随着物品证券化的兴盛 ,尤其是知识产权的出现 ,质权的适用范围进一步扩大 ,权利质权应运而生。由于我国担保法和其他相关法律关于权利质权的规定存在不完善之处 ,因而通过与我国台湾民法典在权利质权的概念、权利质权的标的、权利质权的设定等方面的比较 ,以便对完善立法有借鉴作用。

With the flourishing of commodity security, especially with the emergence of intellectual property, the applicable scope of pledge is increa singly widened. And right pledge arises accordingly. Because there exist imperfect regulations concerning right pledge in our guarantee law and other relevant laws, we can make a comparison with the concept , object, and the establishment of right pledge in "Taiwan Civil Law" for reference for further perfecting our legislation.
