论落马洲河套地区之法律适用和入境管制

“落马洲”已属香港的行政区域并适用香港法律，但其归属之合法性仍有存疑。为以法治精神使“落马洲”的入境管制做到依法行政，兼顾人口控制、人权保护和地方利益，必以《基本法》为原点进行分析和构建，开放和封闭模式固不足取，有限开放模式下，立法会应运用《基本法》和1999年“人大释法”的相关内容中所蕴含的立法裁量权，遵循平等和自由，设定或授权特区政府制定与居留权无涉并与非永久性居民可转化的特殊许可。
