| 摘 要： | 刑法理论界对现行刑法第310条规定的窝藏、包庇罪客观行为存在不同理解。司法实践中应对现行立法进行解释,对＂提供隐藏处所、财物,帮助其逃匿＂、＂作假证明包庇＂作正确理解,准确区分本罪客观行为与相关行为的界限。

| Abstract: | In the theoretical circles of criminal law,there are many disputes on the "actus reus" of crimes of sheltering or shielding,which are defined in section 310 of the current Penal Code.For the "actus reus" of "providing hidden premises or property in order to help the perpetrator to escape" and "providing forged evidence in order to shield the perpetrator",it should be understood in accordance with "the principle of a legally prescribed punishment for a specified crime" regulated in the current legislation and distinguish accurately between some acts with the "actus reus" of crimes of sheltering or shielding. |
