西部少数民族地区农民法律意识探析——以香河村为例

在西部少数民族地区,国家法的权威性受到挑战,有时甚至让位给处于边缘的习惯法。笔者认为之所以出现此情况,是由于法律资源备置不合理、传统文化习俗与国家法的断裂、经济发展不平衡、法律信息不对称和农民法律心理等方面在作祟。因此,要提高西部少数民族地区的农民国家法律意识,就必需实现国家法与传统文化习俗的融合、加强法律资源投入、创新法律宣传手段、把审判带入农村和让农民积极参与市场经济活动等等。

Analyze on legal awareness among farmer in western minority area——A case of Xianghe village

In the western minority regions,the authority of national law is being challenged,sometimes even gives way to the customary law which is well known as marginal law.As to such situation,the author believes the reasons are: unreasonable distribution of legal resources,rupture between traditional cultural practices and the national law,uneven economic development,asymmetry of legal information and legal awareness of farmers.Therefore,in order to improve awareness of national law among farmers in the western minority region,we must do the following things: achieve the integration of national law and traditional cultural practices,strengthen the input of legal resources,innovate propagandistic means of law,take the trial into the rural areas and arouse farmer’s passion to participate market activities,etc.
