论公民行政法上的协助义务

公民行政法上协助义务是指一般公民所承担的帮助或辅助行政机关行政任务完成或实现的一种义务。长期以来我国过于强调协助的义务性,而忽视所应该对应的权利,造成客观上公民不积极履行该协助义务。无论法律直接规定的协助义务,还是因行为造成协助义务,都必须以法律实定为前提,＂见义勇为＂只是一种道德提倡。公民履行行政法上协助义务应获得权利与奖励,公民违反行政法上协助义务的应承担继续履行、应受惩罚、承担赔偿等必要的法律后果。
