中外法定继承人范围和顺序的比较及启示

与世界各主要法系国家相比,我国法定继承人范围和顺序偏窄、偏少。时值中国民法典编纂之际,应将我国法定继承人范围扩展到第三亲等亲属,并将第三亲等亲属列为第三顺序继承人。如此,可增加我国公民获得财富的机会,相应减少国家和集体获得无主财产的机会,以发挥财产的最大效用。

Compared with that of other countries,the scope and order of China's succession law is small and few.In time of China's civil Code being compiled,the scope and order of China's succession law should be extended to the third step of kinship.Thus,the citizens of our country can have more chance to obtain properties,which will lesser the chance for the nation and collective units to get properties without successors and more uses of properties will be made.
