| 摘 要： | 案件分配制度是法院案件流程管理中关乎司法公正的一个重要环节,也是法院改革的一项内容,但国内学者极少关注这一问题。通过对某市两级法院案件分配制度运行状况的调研,可以发现我国法院传统的案件分配制度存在诸多弊端。相较于域外之案件分配制度,我国法院应构建以随机分案为主、指定分案为辅的新规则。

| Abstract: | The mode of cases distribution is an important portion of the procedure by which the court manages cases. It relates to judicial justice and is also the contents of court＇ s reformation. However, domestic scholars pay no attention to this issue. Many flaws can be found in the traditional mode of cases distribution of Chinese courts through investigating operational status of modes of cases distribution of two level＇ s courts in one city. Compared with overseas modes of cases distribution, Chinese courts should establish new rules that appointed distributing cases are subordinate to random distributing cases. |
