受刑人权利保障的文化解读——兼论“和而不同”的人权观

不同的文化孕育了不同的人权观念,本文以文化对于受刑人权利保障的影响为视角,阐明了在中国传统语境下的"合数型"人权观与在西方语境下的"质数型"的人权观的不同之处,认为在中国当前务实的态度是采取"和而不同"的人权观处理受刑人权利保障问题,并认为"和而不同"是不同文化相处的原则态度,而"和而不同"本身就是中国传统文化对人权发展的重大贡献。

Cultural Analysis on Right Protection of A Sentenced Person——Also on the Human Right Outlook of "Harmony but Difference"

Different culture gives rise to different human right outlook.The article illuminates the difference between "composite number model" human right outlook under Chinese traditional culture circumstances and "prime number model" human right outlook under western traditional culture circumstances from the perspective of cultural effect to right protection of a sentenced person.This article also believes that the current pragmatic attitude of china is to adopt human right outlook of "harmony but difference" to deal with right protection of a sentenced person;and believes that "harmony but difference" is the principle attitude for getting along with different culture."Harmony but difference" itself is an important contribution that Chinese traditional culture gives to human right development.
