论我国征地制度改革中土地发展权的配置

我国土地征收制度改革的亮点在于打破了政府的征地垄断权，农民集体可依法享有土地发展收益。这一新政策为正在进行的《土地管理法》修改提出了新的要求。为了给予农民集体的土地发展收益更加稳固确定的保护，在土地管理法的修改过程中，立法者有必要将土地发展收益上升为农民集体的土地发展权。同时有必要将农地转用审批制度与土地发展权制度结合，以实现保护农地与合理分配土地发展收益的双重目的。
