论大调解格局下的人民调解制度定位

大调解格局是对我国社会转型、社会矛盾激增、社会纠纷亟须有效解决的积极回应,是社会管理创新之举。而人民调解制度源于传统调解制度,发展于建国后,对于预防纠纷、解决纠纷曾发挥过重大作用。但在新时期,人民调解一度因不适应社会发展未能充分发挥作用。大调解格局的形成,为人民调解的回归与功能的新定位创造条件。人民调解是社区建设、社区自治的必然要求,可以有市场、管理和司法模式的选择。人民调解是个多元的、开放的体系。

The Positioning of the People' s Mediation System under the Multipartite Mediation Pattern

The multipartite mediation pattern is a positive response to China＇ s social transformation, social con- tradictions surge and effective resolution of social disputes. It is also the innovation of social management. The people＇ s mediation system, which originated from the traditional mediation system and has developed since lib- eration, has played a major role in both preventing and resolving disputes. But in the new era, people＇ s media- tion once failed to give full play of the role in social development because it could not adapt to the social devel- opment. With the formation of the multipartite mediation pattern, it has now prepared well for the return and the new position of the function of people＇ s mediation. The people＇ s mediation, which is the necessary require- ment of community construction and community autonomy, can have options for market, management and the judicial mode. Meanwhile it is a diverse and open system as well.
