法治语境下司法核心公信力探析——对公正裁判力的法理学考量

从"力"的视角考量司法公信力,其内涵包含司法能够赢得社会公众普遍信任和信赖应具备的能力,司法获得社会公众普遍信任和信赖后产生的影响力以及二者之间的相互作用力等三项内容。其中,第一项内容最为重要,应属于司法公信力的核心内容。司法裁判的本质必然要求司法公信系于裁判力,而司法公正的使命必然要求司法公信注重公正裁判,因此,公正裁判力应该成为司法核心公信力的内在构成要素之一。基于司法公正包含实体公正和程序公正两个方面,提升司法公信力则需要在实体和程序两个方面增强公正裁判的能力。司法公正在法治语境下对裁判力的基本要求主要体现为两个统一,即司法职业化和司法民主化之间的辩证统一以及司法能动和司法自制之间的辩证统一。

Research on the Core Elements of Judicial Credibility in the Context of the Rule of Law——Considerations on the Force of Impartial Adjudication from the Perspective of Jurisprudence

Considering from the perspective of the ＂force＂ ,judicial credibility contains the ability that the judi- cature could win the trust and confidence of the public, the influence after the judicature has won the trust and confidence of the public and the interaction force between the two. Among these three components, the ability to win the universal trust and confidence of the public is the most important force, which should be the core el- ement of the judicial credibility. The nature of the judicial adjudication inevitably requires the judicial credibil- ity to hinge on the force of the adjudication, and the mission of the judicial justice necessarily requires the judi- cial credibility to focus on the impartial adjudication. Accordingly, the impartial adjudication should become one internal core element of the judicial credibility. Because the judicial justice contains substantive justice and procedural justice, enhancing the force of the impartial adjudication in both substantive and procedural aspects is required for promoting the judicial credibility. The basic requirements of the force of impartial adjudication in the context of the rule of law present in two integrations, of which one is the integration between the judicial professionalization and the judicial democratization, while the other is the integration between the judicial activ- ism and judicial self-restraint.
