准确把握农地流转中集体组织与农户间的委托代理关系

在当前的农地流转制度与实践中,农村集体组织与农户间构成了一种委托代理关系。但由于农地产权不清晰、农地流转市场不健全、农村集体组织的不完善导致无法建立有效的激励机制、监督机制和制约机制,使得委托代理关系低效。要建立高效的委托代理制度安排,就必须清晰界定农地产权,建立健全农地市场,改革规范集体组织。

The relation ship of agency by agreement between the collective organization and farmers has been formed in practising the system of farmland exchange.But the property right of farmland is not distinct enough,the farmland exchange market has not been established,and the collective organization in rural areas is not improved.This leads to the fact that the effective mechanisms of incentive,supervision and restriction are unable to be established.We should make the property right of farmland distict,establish and improve the farmland market and standardize the collective organization in order to establish an effective system of agency by agreement.
