| 摘 要： | 在近代资本主义经济发展的特定历史条件下,出于资产阶级反封建反专制制度的政治需要,在由特定的社会存在所决定的社会意识的熏陶和浸润下,以认肯理性为特征的自由意志罪过理论脱胎而出,而就历史发展的总体而言,情感因素却一直未能在罪过理论之中获得一席之地。

| Abstract: | Under the particular historic circumstance of capitalistic economy in modern times,in the political need of bourgeoisie opposing feudal autocratic system as well as the influence and infiltration of the social ideology determined by particular social reality,the crime theory of free will with affirming rationality as one of its natures comes into being.However,as far as the historical development is concerned,feeling factors haven't been studied in the crime theory of free will. |
