我国警察权再配置的法律问题分析

在法治国家的背景下，政府的行政管理体制和管理职能不断发生变化，对作为典型行政权的警察权提出了新的要求，既有的警察权配置面临着各种问题和挑战，已经不能满足社会形势的发展需要。文章从对警察权的性质和既有配置规则的分析入手，提出了警察权再配置的立法构想。

An Analysis of Legal Issues about the Reallocation of Police Power in China

Under the background of the rule of law, the administrative system and managementfunctions of the government are changing constantly, which put forward new requirements to police power, a kind of typical administrative power. Tile existing allocation of police power is facing various problemsand challenges, which can＇t meet the needs of the social situation. Therefore, this article put forward legislative conceptions of reallocating police power by starting from analyzing the properties and the existing rules of police power.
