| 摘 要： | 西方法治的生成主要有赖其文化、经济、政治、法律基础的同时同向务实;以法治生成所依凭的社会基础的来源不同,西方法治的生成模式分为内生型法治和外生型法治两大类;当代中国在对法治生成模式进行选择时,应当把"治标"和"治本"结合起来,解决中国传统社会缺乏以人的自由权利和理性精神为核心的文化基因和实体价值的问题.

| Abstract: | The generation of the western rule-by-law is dependant on the strong base of culture,economy,politics at the time and in all ways;the society base of the rule-by-law originated differently,the western rule-by-law can be divided into two major classes: endogenous and exogenous;when the modern China is choosing between the modes of the generation.We should combine the "temporary solution" and "permanent cure" together to solve the cultural gene and material value problems of the Chinese traditional society that lacks a core of free rights and rational spirit. |
