科学发展观视野下期待可能性理论的重新审读

期待可能性是根据行为人行为当时的客观具体情况．期待行为人不做出犯罪行为而实施合法行为的可能性。意志相对自由是期待可能性的哲学基础，人性的宽容是期待可能性的人性基础，刑法的谦抑是期待可能性的法理基础。期待可能性的认定应以行为人的认识为标准。我国刑法应当确立期待可能性理论，这不仅有利于我国刑法理念的更新，也有助于我国犯罪构成体系的完善。

Expectation probabilit is the possibility that actors make acts of legal acts in accordance with the objective of the specific circumstances at the time.Relative freedom of will is the philosophy basis of the expectation probabilit. The tolerance of human nature is the humanity basis of the expectation probabilit. The modestly restraining limitation of the criminal law is the legal basis of the expectation probabilit.We should acknowledge the function of establishing the expectation probabilit in criminal law,which contributed to not only update the concept of the criminal law,but also perfect the system of the constitution of crimes.
