| 摘 要： | 依现有票据抗辩理论,欠缺行为能力的抗辩被视为对物抗辩的一种类型,属于不受限制的抗辩。本文认为,不论是从民法理论的角度,还是从票据法理论的角度来看,欠缺行为能力的抗辩都应是一种可限制的抗辩。在此基础上,本文着重讨论了限制的具体情形及效力问题。

| Abstract: | According to the existing theory of bill plea,the plea of lack of behavior ability is regarded as a type of real plea,belonging to the unlimited plea.This essay thinks that in spite of observing from the civil law theory or observing from the bill law theory,the plea of lack of behavior ability should be a limited plea.On this basic,this essay emphatically discusses the problems of Concrete situation and effect of the limit. |
