关于司法的社会效果内涵之评析

良好的司法社会效果必须建立在严格依法的基础上 ,以得到社会的认同为必要 ,并有利于改革、发展与稳定。衡量司法的社会效果 ,需要正确界定社会效果与社会评价、司法职能目的、法律效果、司法公信力、法律秩序等的关系问题。通过分析论述 ,文章得出结论 :司法的社会效果主要体现在司法对社会的推动和社会对司法活动的认同性。

Comments on the Social Effect Connotation of Judicature

Good judicial social effects must be based on the strict obedience of law so as to get the recognition of the society. To measure the judicial social effects, it is necessary to elaborate the relationships among social effects and social evaluation, judicial functions, legal effects, judicial reliability, legal order etc. This paper concludes that judicial social effects are mainly embodied by the fact that if the judicature has propelled the society forward and if the judicial activities has got the public recognition.
