| 摘 要： | 我国是一个地域广阔且具有五千年历史文明的国家,在地域和文化不同的背景下,一部成文法很难解决生活中各种法律问题。民间习俗和国家法存在着不可避免的冲突,国家法因国家制定而产生,民间习惯则缺乏法律根据。解决民间习惯与国家法的冲突问题,改善我国法律规范,构建合情合理的法律体系是当今社会需要解决的问题。

Research on the Judicial Application of Folk Custom |

| Abstract: | Our country is a vast area and has five thousand years of civilization, and has different geographical and cultural background. A statute is difficult to solve all kinds of legal issues in life. Between folk customs and national law, there are inevitable conflicts. National law comes from the countries’ development, while the folk custom is lack of legal foundation. In order to solve the conflicts, it is urgent to improve the legal norms in our country and construct a reasonable legal system in today's society. |
