| 摘 要： | 刑事和解机制的理论基础是恢复正义理论。构建刑事和解机制能很好地兼顾效率与公平,同时也顺应国际刑事司法的潮流及和谐社会的内在需求。完善刑事和解制度,应严格控制其适用范围和条件,加强刑事和解过程的控制与监督,建立健全刑事被害人赔偿和国家补偿制度。

| Abstract: | The author was talking about the conception of the criminal reconciled and it's theory basis,setting forth the necessity and the feasibility of building the criminal reconciled system. At last,the author was pointing out the measures of perfecting the criminal reconciled system. Namely,control the application scope or the condition of the criminal reconciled,tighten up the process of the criminal reconciled management or control and son on. |
