已成立的法律要获得普遍的服从,首要的一点就是法律规范必须明确、具体和完备。同时对犯罪最具约束力的不是刑罚的严酷性,而是刑罚的必要性,它需要辅之以相应的社会配套机制,切实减少对社会成员不合理的限制,结社会成员提供一个平等、自由发展的空间,最大限度地降低个体对抗社会和犯罪的可能性。

An Exploratory Research on the Inducement of a Crime

If the statutes are to acquire universal obedience, definitude, reification and maturity are the all-important elements of the decided laws and rules. In the mean while, the most important leash for crime is not the asperity of the punishment but its necessity. The execution of punishment requires supports from wholesome relevant social systems to decrease unreasonable restrictions for social members and to offer an equal and free development space for them, so as to reduce as much as possible the possibility of social individual to react against society and commit a crime.
