| 摘 要： | 现代化进程中的法制现代化所涉及的不单纯是法律制度构建问题,而在深层次上,更是一个包括社会结构、社会文化的重构与转变问题。历史事实和现实实践一再表明,法制现代化离不开一种普遍信任的社会文化来启动和支持。普遍信任,是法制现代化最为深层的内驱力,也是民主、法治和市场经济赖以生成和确立的社会文化根基。普遍信任的社会文化,生成于有限政府及民众习惯于合作、自治的开放式社会结构之中。探究普遍信任的生成及其对于法制现代化的根基意义,对后发现代化国家避免和克服本国法制现代化进程中的价值理性贫困和危机具有深刻启示价值。
