关于西方刑法史研究的几个问题

中国近现代刑法是一个舶来品,因此,要使其真正本土化,让理论和实务各界真正熟悉它、理解它,并运用它来为新时期中国的社会发展服务,就必须进一步了解西方刑法的基本内容,了解西方刑法中各项理念和制度、原则的起源及其流变.然而,到目前为止,我国虽然已经出版了众多的刑法学著作和教科书,但关于西方刑法史研究的论著还非常少.因此,分四个部分对西方学术界关于刑法的定义、西方刑法的历史起源、近代西方刑法的变革、第二次世界大战后西方刑法的发展趋势作初步论述.

Some Researching Issues on the History of Western Criminal Law

The modern Chinese criminal law is imported from the western world. As a result, we must understand the fundamental contents, the spirits, the systems, the principles, the origins and the development of western criminal law so that they can be really localized, applied by both researchers and the practitioners on the basis of familiarity and understanding to be conformed with the social development in contemporary China. However, although many works and text books on criminal law have been published, few of them concern the history of western criminal law. As a first step of the research, this article includes some commentaries on four aspects of western criminal law:its definition, historical origin, modern reform and the development tendency after the Second World War.
