量刑对象视野下的量刑程序改革

刑法现代化下的量刑应是指刑事责任的裁量,其蕴含着量刑对象是犯罪人这一量刑基本理念,要求量刑程序应独立于定罪程序,刑事审判应先解决定罪问题,后解决量刑问题。然而,《量刑程序意见》所确立的相对独立量刑程序并不完全符合如此量刑理念的要求,该模式在很大程度上致使当前的量刑程序改革陷入困境。有鉴于此,在被告人不认罪或者辩护人作无罪辩护的案件中建立独立量刑程序模式,应是我国量刑程序改革所要努力的方向。

Sentencing Procedural Reform in the View of Sentencing Objects

The concept of sentencing under the Criminal Code modernization should refer to the judgment of criminal responsibility ,which contains the idea of ＂anyone to be sentenced is the offender＂.It requires that the sentencing process should be independent of the conviction procedures ,and the criminal justice issues should be re-solved before the sentencing justice .However,the relatively independent sentencing process established by Senten-cing Procedures Opinionsdoes not completely comply with the requirements above ,and the model, to a large extent, leads the current sentencing procedural reform to trouble .In view of this,the establishment of an independent sen-tencing model in the cases where the defendant does not plea or fights for unguilty should be what we attempt in the future sentencing procedural reform .
