民工潮--中国法治的一种入径

传统法律文化同现代法治发展的冲突,造成我国当前法治困境的出现.中国城乡对立的二元社会经济结构是导致法治困境产生的根本原因,它同时也是民工潮发生的社会历史根源.除在根本上缩小城乡经济发展水平差距外,从思想层面上消除城乡法治观念的较大差异是解决法治困境问题的关键所在.民工潮现象与法治困境有着共同的渊源关系,民工在流动过程中无意间成为沟通农村与城市、传统与现代法律观念能动的理想介质,他们的自由、平等、契约、权利和现代国家与公民意识等方面的现代法治观念因此得以不同程度的生长和提高.从这个意义上说,民工潮是一场以自生自发的行动为表现形式的中国法治独特的思想启蒙运动,从而不自觉地为解决法治困境开辟了一条崭新的道路,是中国法治的一种入径.最后,本文从处理演进与构建关系的角度,提出了法律应如何对民工潮作出积极回应的建议.

Tide of Peasant Workers--A New Access to China's Ruling with Law

The appearance of present difficulty in ruling with law is caused by the conflict between the traditional legal culture and modern development of ruling with law. The dualistic construction in society and economy between cities and countries is the basic reason. The key lies on reducing the disparity in developments of cities' and countries' economies so well as removing the biggish disparity between ideas of ruling with law in cities and countries in people's brains. The phenomenon of tide of peasant workers shares the same origin with the difficulties of ruling with law. The floating peasant workers have unconsciously become a perfect medium for the communication between the countries and cities, traditional and modern legal sense.
