论行政指导的立法约束

本文概括分析了行政指导实务中存在的若干负面问题,考察评析了国外通过立法对行政指导行为加以约束的常见做法,在此基础上就我国行政指导立法模式选择提出一孔之见,并提出完善我国行政指导法律规范特别是有关行政程序法律规范的一系列具体建议,以推进行政指导法治化进程。

On the Legislative Constrains on Administrative Directives

Based on close analysis of negative influence existing in administrative guidance practice in China, using the experience of foreign countries' legislative restraints on administrative guidance conduct for reference with careful investigation and study, this thesis offers a new view on choosing legislative pattems of administrative guidance, and makes practical suggestions on perfecting our country' s administrative guidance legislation, esp. in the scope of administrative procedure law construction, so as to promote the process to the role of law.
