| 摘 要： | 2010年1月全国人大常委会发布《中华人民共和国村民委员会组织法(修订草案)》。其中第13条及第15条第4款将对于候选人资格的限制授权地方人大进行规定,按照授权明确性原则的要求,此项授权有违宪之虞。建议将《修订草案》的第13条与第15条中关于候选人的资格条件进行合并。
