| 摘 要： | 医疗事故罪是发生在医疗活动中比较难于认定的一种新罪。其主体包括医务人员和其他直接从事保障就诊人生命健康安全的有关人员 ;其客观方面应从时空、原因、后果和因果关系的有机统一上去把握 ;对疏忽大意过失下的预见能力宜采取客观标准为主 ,主观标准为辅。

| Abstract: | Crime of medical accident,which occurs in the medical activities and is difficult to identify,is a new one.Its subject includes medical staff and concerning staff who directly engage in securing the safety of the patients' health and lives.Its subjective aspect should be considered with time,spare,cause,consequence and causality together.The ability to predict under careless negligence,should be judged mainly by objective standard with the help of subjective one. |
