| 摘 要： | 2007年9月1日开始实施的《铁路交通事故应急救援和调查处理条例》第一次以行政法规的形式对铁路交通事故的内涵作出明确界定，并对其归责原则和赔偿限额作出明确规定。而对司法实践中大量存在的非铁路交通事故原因造成的铁路旅客人身伤亡如何处理，本文从基本类型、归责原则和是否适用限额赔偿等方面提出了自己的观点。

| Abstract: | The Rail Accident Emergency Relief and Investigation Regulations, started from September 1 st, 2007, define clearly the meaning of the railway accident for the first time in the form of administrative regulations, and make clear its attribution principles and limits of liability requirements. While, for a large number of non - railway accident causes rail passengers in the judicial practice, how to handle personal injury and death, this article put forward his own point of view from the basic types, the application of attribution principles and limits compensation. |
