| 摘 要： | 刑事人身检查是一种重要的侦查取证手段,在实践中容易侵犯被检查人的身体权、隐私权等基本权利。刑事人身检查的法律属性应为强制措施。完善我国刑事人身检查制度应规定人身检查的原则、身体检查的种类和适用条件、赋予被检查人员应有的诉讼权利、建立对违法进行身体检查所取得证据的排除规则以及样本销毁制度。
