| 摘 要： | 涉法涉诉信访是一种颇具中国特色的权利行为,之所以"问题化",甚至冲击司法机关的权威,确有其深层次的文化原因,包括政法文化传统对形式理性的排斥、民间法文化的深刻影响、实用理性主义的价值取向等等。探析这些原因并在此基础上提出应对之策,将有助于从根本上解决涉法涉诉信访问题。

| Abstract: | Complaint letters and visits relating to lawsuits are a kind of right behavior with Chinese characteristics.Why this act had become a problem and impacted the authority of the judiciary has its deep-rooted cultural reasons,including the exclusion of political and legal tradition on the rational form,the profound impact of civil law culture and practical values of rationalism and so on.Analyzing these causes and putting forward the countermeasures will contribute to settling the problems of complaint letters... |
