| 摘 要： | 格式合同作为规模经济和专业化经济的产物 ,追求交易之迅捷 ,从而降低了交易成本 ,且在社会生活中的运用越来越普遍。本文就试图从各国对格式合同的法律规制的比较分析中 ,谈谈格式合同价值冲突的表现与特征 ,谈谈如何运用法律手段恰当地规制格式合同 ,寻求契约的公平、正义价值。

| Abstract: | As a product of economy of scale and economy of integration, the standard form contract reduces transaction cost by closing a transaction quickly. The application of the standard form contract has become more and more popular in social life.This article analyzes various legislation of different nations for the standard form contract and discusses how to realize its fairness and justice by means of proper legislative guidance. |
