| 摘 要： | 调处制度是中国古代法律制度的独特现象,是中国独特的法律文化,起源很早,经过长时期的发展,到明清时至臻完善。调处制度的形成有其深刻的思想基础和社会基础以及制度环境等诸多因素,它对维护封建社会的家庭、财产关系,增强社会凝聚力,巩固基层政权起过积极作用,但对人们树立法律至上观念以及健全法律制度等方面却起着阻碍作用。

| Abstract: | Mediating System is a unique phenomenon in Chinese ancient legal systems.It is a kind of distinctive Chinese law culture.Its origin is very early.Through long-time development,it has attained extremely when arriving at Ming and Qing Dynasty.The formation of Mediating System has deep thought basis and society basis.It has positive effects on defending family and property relations in feudalist society,strengthening society cohesiveness,and consolidating political power at the grassroots level.But it has negative effects on setting up supreme concept of law and perfecting legal systems. |
