| 摘 要： | 新刑法将遗弃罪从旧刑法中的妨害婚姻、家庭罪调整至侵犯公民人身权利、民主权利罪这一章中。新刑法的这一调整导致了遗弃罪本质的改变 ,即从妨害婚姻家庭的犯罪变为对公民生命、健康的犯罪 ,在此基础上 ,遗弃罪的构成要件也必须进行重构。

| Abstract: | New code of criminal law in 1997 transferred the crime of abandonment from the chapter on crimes of interference with marriage and family to the chapter on crimes of violating the citizens' right of the person and democratic rights. Based on the theory of objective interpretation, the author thinks this legislative change brings about a change of the nature of crime of abandonment, that is, the crime of abandonment is a kind of crime to infronge the citizens' right of the person.Then the author makes totally new requisites to constitute crime of abandonment. |
