探索中国刑事诉讼结构的构建

在我国的刑事诉讼结构中,公检法三机关各自独立地实施刑事诉讼活动,它们之间的分工负责和相互制约经常被互相配合的关系所代替。这种＂生产作业式＂的刑事诉讼结构,实际上与以裁判为中心的结构具有极为鲜明的区别,本文试图分析探索构建一种＂以司法裁判为核心＂的刑事诉讼结构,以期加快中国刑事诉讼法走向法治化和现代化的进程。
