刑事审判中的道德减责问题分析

在刑事审判中,对被告人能否进行道德减责的关键不在于犯罪主体本身的行为,而在于被告人的行为主观动机是否具有道德减责要素,也就是是否以＂他人是目的＂为判断标准。只有具备了道德上规定的有利于平衡自身与他人之间利益关系的行为要素,才会在某种程度上得到道德上的宽恕,在刑事审判中对被告人进行道德减责的命题才成立。一般地说,刑事审判中的道德减责,包括生命减责、自由减责以及利益减责等三个方面。
