| 摘 要： | 滥用职权作为受贿罪中“为他人谋取利益”表现形式之一 ,导致滥用职权罪和受贿罪两个法条的竞合 ,滥用职权罪和受贿罪是部分法和全部法的法条竞合关系 ,应按重法优先的原则适用法条。

| Abstract: | Coincidence of provisions happens between the clauses concerning the crime of abusing power and that of accepting bribes when the crime actor abuses his power and commits an offence "for other people's benefits". Such coincidence reflects a relation between "part of law" and "the entire law". Under such circumstances, in this author's view, the principle that severer punishments have priority to others should be applied. |
