| 摘 要： | 物权变动的立法模式选择,是物权法制定中的焦点问题之一.当今世界各国在物权变动模式上存在几种不同的立法主义,其各有利弊.我国是一个民法法制发育较晚,必须进行广泛法律继受的国家,但法治建设必须借助于本土资源,应从实际国情出发,选择最适合我国的物权变动立法模式.

| Abstract: | The legislative mode selection on the change of real right is a focus problem to establish the law of jus in rem.There are several kinds of legislative mode in the world,each of which has advange and disadvange. China is a country has to carry on extensive law acceptance because of whose civil law system grows up quite late.However,law construction must recur to the native resources,China should select the most suitable legislative mode on the change of real right with a view to its actual state. |
