对义务兵犯罪适用罚金刑的思考

由于受立法环境的影响，我国罚金制度在一些方面仍存在不尽人意之处，给司法操作带来难题。在军事审判中，义务兵适用罚金出现了微妙局面。义务兵为国家提供无偿服务，无独立经济来源，依法适用罚金，难以真正执行。同时，又对其无法适用罚金减、免规则。但不适用罚金，又有悖于罪刑法定的刑罚原则。义务兵身份的特殊性，造成司法实践适用罚金标准不一，引起适用刑罚的不平等，加重义务兵家庭的经济负担，带来裁量中的虚判。针对这一问题，建议建立罚金刑易科军事自由刑制度，完善军事刑罚方式，规范义务兵适用罚金数额

Thinking on the Application of Fine to Compulsory Servicemen

With the effect of legislative environment,the penalty of fine still has some defects after its improvement,which brings some difficulties to the administration of justice.In military adjudication,there is a delicate situation in the application of the penalty of fine to compulsory servicemen.Compulsory servicemen serve their country gratis,so they don't have independent economic resource.It's difficult to apply fine to them according to law and it's not proper to relief the fine.At the same time,it breaks the principle of the punishment for a specified crime if this penalty doesn't apply to them.The peculiarity of the status of compulsory servicemen causes different standards in the practice of justice,causes injustice in applying penalty,increases the economic burden of compulsory servicemen's family,and brings invalid judgement.The writer analyzes this problem theoretically and practically and gives some constructive advice:Build the system of freedom;Perfect the Pattern of miliary penalty;Standardize the amount of fine penalty applied to Compulsory servicemen.
