| 摘 要： | “特留份”制度的产生源于对遗嘱自由的限制,而且从立法上规定被继承人应当为配偶 和其他近亲属保留必要的遗产份额已成为当今各国继承立法的大势所趋。目前我国特留份制度 仍存在许多缺陷与不足,迫切需要加以完善。我国应借鉴两大法系有关特留份制度的先进立法经 验,结合我国实际情况,构建我国继承法中特留份制度的新范式。

| Abstract: | The birth of the system of "legal portion" was to limit testamentary freedom.Furthermore,it is a trend that the legislation should reserve the legal portion for the spouse and nigh relatives.Currently,there are lots of faults in our legal portion system,which needs perfection.We should learn from the advanced experiences in the two legal systems and build up the new scheme of legal potion system in our inheritance law in accordance with the practical situation in our country. |
