城市房屋拆迁中的公民财产权与国家行政权

文章通过展示在我国城市房屋拆迁中的各主体权利和权力的行使,历史地、动态地考察在法律制度存在缺陷的情况下,行政权力的膨胀、公民财产权意识的滋长、行政权力的自我调整以及司法权在行政权与公民财产权之间的角色定位过程。在此基础上进一步提出法治国家中公民财产权与行政权的理想范式。

Right of Property and Right of Administration in the Process of Pulling Down Old Buildings

By exposing the exercising of right of different parties in the process of pulling down old buildings in the cities of China,this article makes a historical as well as dynamical study on the conflict between the right of property and the right of administration under current imperfect law system.Then the author comes out with an ideal model for defining citizen's right of property and official right of administration.
