| 摘 要： | 五四前后的思想文化运动为什么没有产生有效的现代宪政制度,因为我们缺乏形成和革新制度的能力。制度经常是利益斗争和调和的产物;制度需要建立在一定的基本共识基础上;制度的构建还需要法治文化、社会和经济因素以及制度本身的作用。

| Abstract: | Why did not produce effective modern constitutional system before and after the 54 movement,because we lack the ability to form and reform the system.The system is the result of the interests struggle and compromise.The system needs to be founded on the basis of certain basic consensus;the construction of system also have the rule of law,cultural,social and economic facts. |
