| 摘 要： | 国有医院医生收受药品回扣行为既具有应受刑罚处罚的社会危害性又具有刑事违法性。《关于办理商业贿赂刑事案件适用法律若干问题的意见》将国有医院医生收受药品回扣行为规定为非国家工作人员受贿罪,是合法的正当的也是非常及时的,严密了刑事法网,为打击医药行业的商业贿赂特别是针对国有医院医生收受回扣行为提供了法律依据。
