| 摘 要： | 近年来,利用民事诉讼这一合法形式谋取不正当利益的民事虚假诉讼现象不断出现,呈现出愈演愈烈的趋势。民事权利不应该被滥用,民事诉权也不例外。必须建立虚假民事诉讼损害赔偿、立案警示和虚假诉讼嫌疑报告、完善民事证据审查等制度,最终达到规制民事虚假诉讼的目的。

| Abstract: | In recent years,someone made use of the civil litigation to seek illicit interest.These kinds of deceitful litigation cases and phenomena occurred frequently.The civil case right should not be abused,while the civil litigation case right is not in exception.The compensation system of deceitful civil case should be set up,and the case registration and deceitful case suspect report systems should be too.Perfect the check system of civil case proof to reach the aim of regulating the deceitful civil case litigations. |
